1. Introduction

This policy sets out how EDEN EXCHANGE PTY LTD (ACN 152 787 212) (referred to in this policy as "we", "us" or "our") collects, uses, stores, processes and discloses personal information including in relation to use of and access to the edenexchange.com website (the "Site").

2. Changes to our Privacy Policy

Any changes we may make to our Privacy Policy will be posted on the Site or, where appropriate, we will communicate the changes to you by email or other means.

The Site may include links to other websites, plug-ins, social buttons and applications provided by others, including those acting on our behalf. Clicking on those links or enabling those connections may allow third parties to collect or share data about you, and have their own privacy policies. We do not control third party websites and are not responsible for their privacy policies or actions. When you leave the Site, we encourage you to read the privacy policy and terms of use of every website you visit.

4. The personal information we collect about you

Personal information means any information about an individual from which that person can be identified. It does not include information where the identity of the individual has been removed (anonymous data).

We may collect, use, store and process personal information about you, including:

  • contact information, including billing address, postal address, email address, telephone number(s);
  • purchase and transaction information, including details about payments from you and other details of services you have purchased from us, bank account and credit card details;

  • client service information, including your client service enquiries and comments;

5. How is your personal information collected?.

We use different methods to collect information from and about you including through the forms you complete on the Site, you using the services, or by you visiting the Site, corresponding with us by post, telephone, email or otherwise. This includes information you provide when you:

  • create an account on the Site;
  • upload information to be posted on your publicly available business profile page on the Site;
  • participate in our activities and promotions;
  • subscribe to our services or publications including marketing;
  • enter a competition, prize draw, promotion or survey;
  • receive communications from us;
  • give us feedback;
  • submit payments for our services.

  • from other sources including third parties , public information and marketing lists and suppliers of including demographic and profile data; and
  • publicly available sources of information.

If you choose not to provide the personal information we request, we may not be able to supply you with our services.

6. Purposes for which we will collect or use your personal information

We collect and use your personal information for any of the following purposes:

  • to register you as a new user and/or client;
  • to process, manage and deliver the services to you, or otherwise fulfil our obligations arising from any contracts entered into between you and us including to recover any amounts you may owe to us or a third party;
  • to connect you with third parties you request to contact. Such third parties may contact you to inform you of their businesses, services and products;
  • to provide you with news, information or advice about our existing and new products and services and those of our clients or service providers, including for marketing;

  • to enable you to participate in competitions or promotions sponsored by us, or complete a survey, and to offer those to you;

7. Storage and security of your personal information

The information we collect from you may be transferred to, and stored at, a location in Australia or other locations outside Australia including, for example, to our third party service providers who are either located or operate their business overseas such as in India and Philippines. We may store your information in, disclose or transfer your information to those parties who operate or are located outside of Australia. Information you provide on your publicly available business profile may be accessed by persons from outside Australia.

8. Disclosure of your personal information

We may share your personal information with the persons set out below:

  • third parties who visit your publicly available business profile on the Site;
  • third parties you request to contact through the Site;
  • our external service providers including, without limitation, web hosting providers, advertisers, IT systems administrators, mailing houses, newsagents, couriers, payment processors, data entry service providers, electronic network administrators, debt collectors, and professional advisers such as accountants, solicitors, business advisors and consultants;
  • third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal information in the same way as set out in this Privacy Policy;
  • third parties, including authorities, where we are legally obliged to disclose your personal information to them.

We may use cookies for a number of purposes, including but not limited to, to enable us to simplify the logging on process, to help ensure the security and authenticity of members and to enable traffic monitoring.

If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly. We store a number of session cookies to remember your login and allow us to let you securely access the account on your site (for example, when you log in to our services, when you log in to an account on our servers, including our blog).   • Google Website Optimizer - we use this service to anonymously test the performance of different content variations on pages of our Site.
  • Google Ad Services - we use this service to track conversions of our paid advertising to enquiries and to target display advertising to site visitors (re-targeting) when they visit other sites using Google's Ad services.
  • Contentsquare (previously ClickTale) - we use this service to help us understand how people interact with certain pages of our Site so that we can improve usability.

The information these third parties collect may be transferred to, and stored at, a location outside Australia. By accepting cookies, you agree to this transfer, storing or processing of your personal information.

Additionally, many pages of our Site contain social sharing buttons for services including Twitter, Facebook, Google+ and LinkedIn. These buttons enable users to share content through the use of third party cookies which are outside of our control. 10. Retention of your personal information and deletion

We will need to retain your personal information for as long as necessary to fulfil the purposes set out in this policy, for as long as your account is open or in order to provide the services you have requested.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

If you no longer want us to use your personal information for the purposes of providing services to you, please close your account with us by contacting enquiries@edenexchange.com. We may need to retain some of your personal information for the purposes of satisfying any legal, accounting, or reporting requirements or in order to enforce legal agreements we have entered into. Sellers or franchise issuers may also need to retain some of your personal information to comply with their own legal obligations.

You may access personal information we hold about you and update and/or correct it, subject to certain exceptions provided by law. We may charge a reasonable fee that is not excessive to cover the charges of retrieving your personal information from our customer account databases. We will not charge you for making the request.

If we no longer need your personal information, we will take reasonable steps to securely destroy it or render it unable to be identified.

You have the right:

  • to request to access or correct your personal information;
  • to make a complaint to us or to the Office of the Australian Information Commissioner, who may be contacted on 1300 363 992 or online using the forms provided at https://www.oaic.gov.au/about-us/contact-us.

If you wish to exercise any of the rights set out above, please contact us via the methods set out below in section 12.

We may refuse access to the information where the applicable law permits or requires us to do so, such as where granting access to the information may jeopardise the privacy of another individual. Where access is granted we may charge a reasonable fee to cover the costs of providing access to you, such as where it takes a significant amount of time to locate the information.

11.1. What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to help speed up our response.

11.2. Time to respond

We will try to respond to all legitimate written requests by you regarding your personal information within 30 days after receiving them. Occasionally it may take us longer if your request is particularly complex or you have made a number of requests. In this case, we will let you know and keep you updated.
